Gambler sues casino for not protecting him from losing millions

The British Dailymail recently reported on a bizarre lawsuit that was recently filed in the London High Court of Justice.

Han Joeh Lim, a Malaysian millionaire had lost £4 million seven years ago at Aspinall’s, a private gambling club in London. Lim refused to pay his debts and Aspinall’s subsequently sued him.

Now Lim turned the tables and filed a lawsuit in his turn. He rejects claims for payment and points out that the casino did not protect him from his gambling addiction.

Not protected from gambling addiction?

Specifically, Lim points to the British Gambling Act of 2005, which regulates gambling in England, Scotland and Wales. One of the passages of the Act describes that providers of games of chance must ensure that they protect children or vulnerable persons from harm caused by games.

In the complaint, Lim writes, among other things:

Instead of forcing the applicant to take a break, Aspinall’s increased his credit to £2 million. Aspinall’s granted the claimant another credit of £2 million, which he also lost. The claimant was on a losing streak and was visibly distressed and panicking. However, Aspinall’s took advantage of the plaintiff’s desperate attempts to recoup the losses by granting him further funds and more time to gamble.

According to the lawsuit Han Joeh Lim spent 72 hours gambling at the club and lost a total of around £4 million. He was playing baccarat. The marathon session took place back in 2015 and Lim refused to pay the credits granted.

In 2019, Aspinall’s won a case against 62-year-old Lim, who is believed to have a fortune of more than £40 million, according to the Dailmail. The judge also ruled at the time that Han Joeh Lim had breached four court orders and fined him £100,000 for deliberately making dishonest statements at the hearing.

Under these circumstances, it seems unlikely that Lim will succeed with his counterclaim. Aspinall’s stated that the club will defend itself in this matter and requested that the case be dismissed.
